Respected Judge Richard Posner – that’s me and the other one – see eye to eye on the decriminalization of marijuana.

It is criminal to make a criminal of a person seeking to escape reality through non-lethal, non-violent means.

There is not a sinless person on this planet.  We all have our sloppy or sophisticated methods of coping with the vicissitudes of living.  Some of us choose to masturbate in a rest room, others choose to run marathons, and still others choose to bury their head in a book from dawn to dusk.

Though each of these ways may have benefits and disadvantages, one is no more correct than another, unless we wish to play God.  The key component in deciding whether a habit or obsession is acceptable has nothing to do with the majority’s distaste for a lifestyle choice.  The key element is whether such an activity poses a physical threat to the community.

Most definitely, marijuana poses far less threat to society than does the condoned habits of the majority, alcohol and tobacco.  The morals of society will not change an inkling because marijuana is legal.  Stupid folks smoke or drink when doing activities requiring concentration and responsibility.  Outlawing a rather innocuous drug when taken in moderate doses – which IS the case in marijuana – creates a criminal class which should not exist in a democracy.

Even though there is no universally accepted definition of  ‘democracy’, there are two principles that any definition of democracy includes. The first principle is that all members of the society (citizens) have equal access to power and the second that all members (citizens) enjoy universally recognized freedoms and liberties.

Notice this premise says “all members” rather than only those whom we agree.  Democracy, as penned in the United States, dismisses this principle and has created in its stead a theocratic thug society led by Christians.  The Christian witch burning is evident in  almost every sting operation, whether it is to catch a politician soliciting sex in a toilet stall or entrapping a successful business leader buying an ounce of Maui Powy.

Most of the people in the prison system do not belong there, though a few definitely do.  It is a moral shame that the United has more people in its gulags at one time than Stalin or Hitler ever did.  There is a similarity between the fascists and the democrats – most people are innocent of all crimes other than being human.

If we are to entrap people, let us jail the father smoking cigarettes around his pregnant wife or newborn.  Let us lock up politician-thieves who easily spend money that they don’t have for projects which do little to further society other than to prolong their careers.   Let us jail parents who serve minors alcohol and give a wink to their charges when  they come home sloppy drunk in their freshman years.  Let us hang those who reject job applicants because they look Arab or too dark.

Ah, the gotcha society is nasty and as undemocratic as they come.  But as a judge, I forgive them for they know not what they do.  But if they continue to taunt sinners in the name of living on a higher ground, let us commit anarchy and behead these witch hunters before we all become somatized and chained for eternity.
